Terms & license

The rules, plain and simple.

These terms apply when you download the Time Shift Blur Trial or buy Time Shift Blur Pro on sempolak.com, including purchases completed through the Shopify checkout and Pro copies unlocked with a gift code. By downloading or buying, you agree to them.

Digital product

You get a download, instantly. Nothing is shipped, so there is nothing to return. All sales are final.

One person, any project

Your copy is licensed to you. Use it in as many personal and commercial projects as you like, including client work.

Don't pass it on

The files are licensed to you alone. Sharing or forwarding them is copyright infringement: your license ends immediately and we enforce our rights, including damages and legal costs.

1Who you're dealing with

Time Shift Blur is made and sold by Unfolded, registered in the Netherlands.

Payments for Pro are processed through Shopify and its payment providers. Shopify is the checkout, not the seller. "We", "us" and "our" in these terms means Unfolded.

2What you get

Time Shift Blur is a digital product: an effect for DaVinci Resolve delivered as .drfx files, together with a user guide. It comes in two versions.

  • Trial. A trial version with a limited set of looks and controls, and a watermark on the image. No charge, no updates promised.
  • Pro. The full version: all looks, all controls, every look as a drag-on effect, and updates with new looks and effects for as long as we make them. One-time purchase.

What is included in each version is described on the product page at the time of your download or purchase. Time Shift Blur is a plug-in for DaVinci Resolve; you need your own copy of a compatible Resolve version to use it. DaVinci Resolve is a product of Blackmagic Design and is not included or affiliated.

3Delivery

The trial is delivered as a download on the product page and through the link in the email you receive after signing up. Pro is delivered as a download link on the order confirmation page and in the confirmation email from Shopify, immediately after your payment is confirmed. Gift codes unlock a download on sempolak.com/gift and are valid for 24 hours after the first download.

You are responsible for entering a correct email address and for saving the files. If a link stops working or you lose your files, email us with your order number and we will send you a fresh copy.

4Price and payment

Prices are in euros. For buyers in the European Union, prices include VAT; the VAT amount is shown at checkout. Outside the EU, prices are shown without VAT and local taxes or duties, if any, are your responsibility. Payment is taken in full at the time of purchase through the payment methods offered in the checkout.

We may change prices at any time. A price change never affects a purchase you have already completed.

5No returns or refunds

Time Shift Blur is digital content delivered instantly. By completing your purchase you expressly ask us to deliver it immediately, and you acknowledge that you lose your right to cancel (the 14-day right of withdrawal) as soon as delivery starts.

This is the rule for digital content that is not supplied on a physical carrier (Article 6:230p(g) of the Dutch Civil Code, Article 16(m) of the EU Consumer Rights Directive). Once the files are available to you, the purchase cannot be undone. All sales are final.

This means we do not accept returns, and we do not refund because you changed your mind, bought by mistake, don't like the result, no longer need it, or didn't check that your Resolve version is compatible. Return requests filed through Shopify for these reasons will be declined.

What we do fix. If the download is broken, the files are corrupt, or you were charged more than once, email us within 14 days with your order number. We will replace the files or correct the charge, and if we can't make it work for you, we will refund you. Your statutory rights as a consumer regarding faulty digital content are not affected by these terms.

Please try the trial first if you want to see whether the effect runs on your system. It installs the same way.

6Your license

You don't buy the effect itself; you buy a license to use it. Time Shift Blur, including every look, preset, animation, design, name and the user guide, is and remains the copyrighted work of Unfolded.

With your download or purchase you get a personal, non-exclusive, non-transferable, worldwide license for one person, which lets you:

  • install and use Time Shift Blur on the computers you personally use;
  • use it in unlimited personal and commercial projects, including client work, social media, advertising, film, broadcast and streaming;
  • publish, sell and license the videos you make with it, without credit (though a tag is always appreciated);
  • keep using the version you have for as long as you like. A Pro license does not expire.

A license covers one person. If several people on a team want to use it, each of them needs their own copy. A gift code is personal to the person who receives it. Companies buying for staff: buy one Pro per user, or email us for a team arrangement.

7Sharing is not allowed

The license is personal. The files may not be passed on to anyone else, in any form, whether you paid for Pro, received a gift code or downloaded the trial. Specifically, you may not:

  • forward, send, share, upload, post, torrent or in any other way make the .drfx files, looks, presets or user guide available to anyone else, in private or in public, free or paid;
  • share your download link, order confirmation, gift code or Pro files, or let anyone else install or use your copy;
  • sell, resell, rent, lend, sublicense, bundle or give away the files, in whole or in part, as they are or modified;
  • include the looks, presets, animations or any part of the effect in your own plug-ins, presets, templates, LUT or effect packs, courses, or any other product or download, free or paid;
  • copy, decompile, extract, reverse engineer or rebuild the effect or its looks, or remove or hide the trial watermark, copyright or licensing notices;
  • use the files or looks to train, fine-tune or prompt AI or machine-learning systems;
  • present the effect or its looks as your own work.

Anyone who wants Time Shift Blur can get it at sempolak.com/blur. The trial costs nothing; Pro is a single, small payment.

8Consequences of unauthorised sharing

Time Shift Blur is protected by copyright under the Dutch Copyright Act (Auteurswet) and international copyright treaties, which means it is protected in virtually every country. Passing on, uploading or redistributing the files without our written permission is copyright infringement and a breach of this agreement. Dutch and EU law (including the EU Enforcement Directive 2004/48/EC) give us the following rights, and we use them:

  • Immediate termination. Your license ends without notice and without any refund. You must delete every copy of the files and may no longer use the effect in new work.
  • Revocation. Gift codes, download links and future updates tied to your purchase are withdrawn, and we may refuse future sales to you.
  • Damages. We are entitled to compensation for the damage caused by the infringement, including lost revenue for the copies distributed and the costs of tracing the source.
  • Legal costs. In copyright cases, Dutch law (Article 1019h Code of Civil Procedure) allows the rights holder to recover the full, actual legal costs from the infringer. Those costs typically run far higher than the price of the product.
  • Takedowns. We have infringing copies removed from platforms, hosts, forums, chat servers and file-sharing services through takedown notices, and we request the account details of the uploader.
  • Criminal law. Deliberate copyright infringement is a criminal offence under Articles 31 to 31b of the Dutch Copyright Act, punishable by fines or imprisonment. Serious cases, such as selling copies or distributing them to a group, are reported to the authorities.

Copies are traceable. Every Pro download is linked to an order number, an email address, a payment and a timestamp. A copy that turns up elsewhere can be traced back to the original purchase.

If you come across Time Shift Blur being shared, please report it to [email protected]. Every report is followed up.

9Updates and support

Pro includes updates: when we release new looks, effects or improvements to Time Shift Blur, you get them at no extra cost. We decide what goes into updates and when they are released. Updates are an extra, not a promise of specific features or a fixed schedule, and development of Time Shift Blur may stop at some point. The version you have keeps working.

The trial does not include updates. Support is provided by email at [email protected], as time allows, in English or Dutch. Compatibility with future DaVinci Resolve versions depends on Blackmagic Design and is not guaranteed.

10No guarantees, limited liability

Time Shift Blur is made with care, but it is provided "as is". We do not guarantee that it works with every version of DaVinci Resolve, every operating system or every type of footage, that it runs without errors or interruptions, or that it gives any particular result in your project.

To the extent the law allows, we are not liable for indirect damage such as lost profit, lost data, missed deadlines, or damage to projects, and our total liability for anything connected to Time Shift Blur or these terms is limited to the amount you paid for it. Nothing in these terms limits liability for intent or gross negligence, or any right you have as a consumer under mandatory law.

11Your email

For the trial, we use your email address to record your download. You only receive updates about new effects, breakdowns and offers if you tick the box, and you can unsubscribe at any time. For Pro, Shopify processes your order details to deliver your files and handle payment, and we use them to provide support and updates. We do not sell or share your details with anyone else.

12Changes and law

We may update these terms. Changes apply to downloads and purchases made after they are published on this page, not to purchases you have already completed. Dutch law applies. If you are a consumer in the EU, you also keep the protection of the mandatory consumer law of the country where you live. Disputes are brought before the competent court in the Netherlands, unless mandatory law says otherwise. If any part of these terms turns out to be invalid, the rest stays in force.
